Can you use marijuana legally if you have a C.D.L.?

i have a friend that thinks that marijuana helps his back pain,he drives small dump trucks, and other small trucks on a construction sight, they are small truck but you still have to have a C.D.L. that means the state where he lives does random drug testing, if he has a medical marijuana card from a doctor and test posative for marijuana will he lose his C.D.L. and his job most likely. i work with him and i never seen him use marijuana on the job,and he claims he just uses it after work to take care of his back and sleep better. he is a great truck driver and employee.i dont no how he has got away with it so far but he has.

No, unless you get an exemption at the state and federal level since drug testing for commercial drivers is done to meet requirements at both levels.

Reply:Even though it is legal in some states, the supreme court has ruled that it is up to the companies discretion on whether or not it wants to fire the employee for using Medical Cannabis.





Whether or not you have a legal prescription, you can not drive while under the influence. The same legal standards are true for alcohol and for prescription drugs. Under the influence is under the influence. There is no gray area here. Even with a prescription, you need to use wisdom.





As far as taking it after work to get to sleep and help the pain is understandable. But he needs to find out where his company stands concerning this matter. I would suggest discretion. But then again, that is just more common sense.
Reply:No. When he goes for his CDL physical, they'll do a drug screen on him. Even with a medical mj card, it's doubtful that the state will be willing to renew his CDL if he tests positive for mj. How does he get away with it? There are ways to cheat on this test. :)
